YOU LEGEND PROMOTION TERMS AND CONDITIONS

The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006 (HWT) in association with News Limited companies publishing newspapers in South Australia and Western Australia.
Instructions on how to enter form part of the terms and conditions of entry. By registering and participating, users agree to be bound by these terms and conditions. These terms and conditions apply to the submission of videos on the You Legend site at http://www.superfooty.com.au/youlegend/, http://www.adelaidenow.com.au/youlegend/ or http://www.perthnow.com.au/youlegend/.
Entry is open to residents of Australia only who are 16 years of age and over. If any winner is under the age of 18 years of age then the prize will be awarded to their parent or guardian.
The following entrants are welcome, however are not eligible to be awarded any prizes for participation in this You Legend promotion: (i) employees of, or contractors to, HWT, game sponsors or any of the agencies involved with this competition, and (ii) members of the immediate family of such employees and contractors.
To enter the promotion entrants must submit a video capturing a sporting moment, on the You Legend page. To place a video, entrants need to go to http://www.superfooty.com.au/youlegend/, http://www.adelaidenow.com.au/youlegend/ or http://www.perthnow.com.au/youlegend/ click on �Upload Video�, enter their details and follow the instructions to upload a video. A Video message is considered placed, once the video appears on the dedicated website. Rejected messages are not considered entries.
The promotion commences at 12.01am AEST on 26/03/09 and closes at 10am AEST on 26/09/09.
Multiple entries will be accepted, but must consist of separately placed videos.
Each video uploaded must not be bigger than 25MB in file size and must not be more than 3 minutes in duration and failure to comply with these requirements will render the entry invalid.
You must not include any image of, or voice of, any other person in your video without that person's express consent. You warrant that if any such thing is included, you have obtained the express consent of the relevant person.
You must not include in your Video any content that contravenes any law, infringes the rights of any person or is obscene, offensive or otherwise inappropriate. Any submission that includes any content that involves nudity, malice, swearing or potentially defamatory material will not be accepted onto the site.
By submitting a video all entrants warrant that the work is an original artistic work of the entrant. You must not include in your Video any literary, dramatic, musical or artistic work, any video or sound recording, or any other item in which copyright subsists, unless you are entitled to do so. If you have any doubts about whether you have the right to include (for example) recorded music in your Video, you must not include it. By including any item in your Video, you warrant that you are entitled to do so.
The entrant agrees to indemnify HWT against claims and costs by third parties arising from a breach of paragraphs 9, 10 and 11.
Once submitted the Video becomes the property of HWT and as a condition of entry into this promotion each entrant agrees to assign all of their rights title and interest (including copyright) in the video to HWT.
HWT may at any time reject and/or remove from access by the public any video that it considers (in its sole judgment) infringes these terms and conditions, or any other applicable terms. HWT will have no liability to you in that regard.
HWT is not liable for any technical difficulty or error that results in your video being wholly or partly unavailable for online access, for any period of time.
Once submitted, you may not alter your video. At HWT's discretion, you may be permitted to have your Video removed from online access.
You acknowledge that your Video will be made available online and will be accessible to the general public. HWT may copy the Video, cause the Video to be seen and heard in public, and communicate the Video to the public. It may also allow third parties to do these things.
All decisions relating to the conduct of the promotion are at the sole and exclusive discretion of HWT and are final and no correspondence will be entered into.
Major prize:

The best overall video, as determined by HWT based on but not limited to literary and creative merit will win a Panasonic VDR-D50 DVD Video Camera $530. The major winner will also win a 4GB iPod Nano valued at $199.

HWT judges will select the best overall entry selected from the entrants based on but not limited to literary and creative merit and the winner of the major prize at 3pm on Monday 28/9/09 at the premises of HWT, 40 City Road, Southbank 3006. Judging will be conducted by suitably qualified judges able to assess the quality of the entries and each entry will be judged on its merits.

HWT will attempt to notify the major winner by phone within 24 hours. The major and minor winner's will be contacted by mail within 5 working days and their names will be published and in the Herald Sun Public Notices on 5/10/09 and their winning video will appear on the You Legend website.

Total major prize value is $729
The major and minor prizes will be awarded to the person who submitted the video and not the person/s featured in the video.
The prizes are not exchangeable and where applicable cannot be taken as cash. Any additional charges are the responsibility of the winner. HWT accepts no responsibility for any variation in the prize value.
To the full extent permitted by the law, HWT, its employees, officers, agents, and its parent companies and subsidiaries and any participating News Limited Company excludes liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity, revenue or profit) arising directly or indirectly out of or in connection with this promotion. Each winner must sign and return any liability release provided by HWT as a condition of any prize being awarded. Failure to return the signed releases will result in the entitlement to the prize being forfeited and the selection of another winner.
Nothing in these terms and conditions limits or excludes any condition or warranty that is implied by legislation and cannot be limited or excluded. However, all other warranties of HWT are excluded, and HWT's liability to you on any basis (including without limitation in negligence) is excluded so far as possible. If any condition or warranty cannot be limited or excluded, HWT's or its servants or agents liability under it will be limited (where permissible) to, at HWT's election, replacing or resupplying the relevant goods or services or paying the cost of such replacement or resupply.
HWT is not responsible for any incorrect or inaccurate information, either caused by persons or by any of the equipment or programming associated with or utilised in this promotion, or by any technical error that may occur in the course of the administration of this competition. HWT assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of HWT which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, HWT may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the relevant gaming authorities where required.
HWT collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. HWT may share entrants' information with persons or entities assisting in the conduct of the promotion and with companies who are prize partners. HWT for publicity purposes may use the name and if applicable, image of the winners and persons accompanying the winners.

We would like to share your information with our related companies so that they can contact you with offers. By marking the "opt-in" boxes on the Web Site entry form you consent to the storage and use of your personal information by HWT, and any participating News Limited company, or other connected entities for the marketing purposes as set out next to opt-in boxes and as detailed above.

If any prize or any part of a prize becomes unavailable for reasons beyond HWT's control HWT will endeavour but is not obliged to provide a substitute prize of equivalent value.
If any prize winner cannot be contacted within 5 working days of the winner being determined, or does not claim their prize within 28 days of the winner being determined, HWT may dispose of the relevant prize at its discretion.
