THE BOUNCE PROMOTION TERMS AND CONDITIONS

The promoters are the Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006 (HWT) and Channel Seven Melbourne Pty Ltd (ABN: 50 004 342 303) of 160 Harbour Esplanade, Docklands, Vic 3008.
Instructions on how to enter form part of these terms and conditions of entry. By registering and participating, users agree to be bound by these terms and conditions. These terms and conditions apply to the submission of videos on The Bounce site at www.heraldsun.com.au/bounce
Entry is open to residents of Victoria only who are 16 years of age and over. If any winner is under the age of 18 years of age then the prize will be awarded to their parent or guardian.
The following entrants are welcome, however are not eligible to be awarded any prizes for participation in The Bounce promotion: (i) employees of, or contractors to, HWT or Channel Seven Melbourne, game sponsors or any of the agencies involved with this competition, and (ii) members of the immediate family of such employees and contractors.
To enter the promotion entrants must submit a video capturing a centre bounce of a football on The Bounce page. To place a video, entrants need to go to www.heraldsun.com.au/bounce , click on "Upload Video", enter their details and follow the instructions to upload a video. A Video message is considered placed, once the video appears on the dedicated website. Rejected messages are not considered entries.
The promotion commences at 12.01am AEDST on 3/03/2010 and closes at 5pm AEDST on 22/03/2010.
Multiple entries will be accepted, but must consist of separately placed videos.
Each video uploaded must not be bigger than 25MB in file size and must not be more than 3 minutes in duration and failure to comply with these requirements will render the entry invalid.
You must not include any image of, or voice of, any other person in your video without that person's express consent. You warrant that if any such thing is included, you have obtained the express consent of the relevant person.
You must not include in your Video any content that contravenes any law, infringes the rights of any person or is obscene, offensive or otherwise inappropriate. Any submission that includes any content that involves nudity, malice, swearing or potentially defamatory material will not be accepted onto the site.
By submitting a video all entrants warrant that the work is an original artistic work of the entrant. You must not include in your Video any literary, dramatic, musical or artistic work, any video or sound recording, or any other item in which copyright subsists, unless you are entitled to do so. If you have any doubts about whether you have the right to include (for example) recorded music in your Video, you must not include it. By including any item in your Video, you warrant that you are entitled to do so.
The entrant agrees to indemnify HWT and Channel Seven Melbourne against claims and costs by third parties arising from a breach of paragraphs 9, 10 and 11.
Once submitted the Video becomes the property of HWT and Channel Seven Melbourne and as a condition of entry into this promotion each entrant agrees to assign all of their rights title and interest (including copyright) in the video to HWT and Channel Seven Melbourne. Entrants acknowledge Channel Seven Melbourne intend to use the winning submission in the opening credits of the first episode of The Bounce television program. The submission is not restricted to use on The Bounce only and may be used elsewhere or not at all.
HWT and Channel Seven Melbourne may at any time reject and/or remove from access by the public any video that it considers (in its sole judgment) infringes these terms and conditions, or any other applicable terms. HWT and Channel Seven Melbourne will have no liability to you in that regard.
HWT and Channel Seven Melbourne are not liable for any technical difficulty or error that results in your video being wholly or partly unavailable for online access, for any period of time.
Once submitted, you may not alter your video. At HWT and Channel Seven Melbourne's discretion, you may be permitted to have your Video removed from online access.
You acknowledge that your Video will be made available online and will be accessible to the general public. HWT and Channel Seven Melbourne may copy the Video, cause the Video to be seen and heard in public, and communicate the Video to the public. It may also allow third parties to do these things.
All decisions relating to the conduct of the promotion are at the exclusive discretion of HWT and Channel Seven Melbourne and are final and no correspondence will be entered into.
The best overall video selected from the entries based on but not limited to literary and creative merit will win a Sherrin Football signed by the panel of the Channel Seven Melbourne's The Bounce television program.

The prize winner will be selected by 10am on Tuesday March 23, 2010 at the premises of Channel Seven Melbourne at 160 Harbour Esplanade Docklands Melbourne Vic 3008. Judging will be conducted by suitably qualified judges able to assess the quality of the entries and each entry will be judged on its merits.

HWT will attempt to notify the winner by phone by 5.30pm Wednesday March 24, 2010. The prize winner will be contacted by mail within 5 working days and their names will be published and in the Herald Sun Public Notices on Friday 26/03/10 and their winning video will appear on The Bounce website and may appear in the opening credits of the first episode of the Channel Seven Melbourne's the Bounce television program.

Total prize value is $119.
If the prize winner cannot be contacted within 5 working days of the winner being determined, or does not claim their prize within 28 days of the winner being determined, HWT may dispose of the relevant prize at its discretion.
The prize will be awarded to the person who submitted the video and not the person/s featured in the video.
The prize is not exchangeable and where applicable cannot be taken as cash. Any additional charges are the responsibility of the winner. HWT and Channel Seven Melbourne accept no responsibility for any variation in the prize value.
If any prize or any part of a prize becomes unavailable for reasons beyond HWT and Channel Seven Melbourne's control HWT and Channel Seven Melbourne will endeavour but is not obliged to provide a substitute prize of equivalent value.
To the full extent permitted by the law, HWT and Channel Seven Melbourne, its employees, officers, agents, and its parent companies and subsidiaries and any participating News Limited Company excludes liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity, revenue or profit) arising directly or indirectly out of or in connection with this promotion. Each winner must sign and return any liability release provided by HWT and Channel Seven Melbourne as a condition of any prize being awarded. Failure to return the signed releases will result in the entitlement to the prize being forfeited and the selection of another winner.
Nothing in these terms and conditions limits or excludes any condition or warranty that is implied by legislation and cannot be limited or excluded. However, all other warranties of HWT and Channel Seven Melbourne are excluded, and HWT and Channel Seven Melbourne's liability to you on any basis (including without limitation in negligence) is excluded so far as possible. If any condition or warranty cannot be limited or excluded, HWT and Channel Seven Melbourne's or its servants or agents liability under it will be limited (where permissible) to, at HWT and Channel Seven Melbourne's election, replacing or resupplying the relevant goods or services or paying the cost of such replacement or resupply.
HWT and Channel Seven Melbourne are not responsible for any incorrect or inaccurate information, either caused by persons or by any of the equipment or programming associated with or utilised in this promotion, or by any technical error that may occur in the course of the administration of this competition. HWT and Channel Seven Melbourne assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of HWT and Channel Seven Melbourne which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, HWT and Channel Seven Melbourne may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the relevant gaming authorities where required.
HWT and Channel Seven Melbourne collect entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. HWT and Channel Seven Melbourne may share entrants' information with persons or entities assisting in the conduct of the promotion and with companies who are prize partners. HWT and Channel Seven Melbourne for publicity purposes may use the name and if applicable, image of the winners and persons accompanying the winners.

By marking the "opt-in" boxes on the Web Site entry form you consent to the storage and use of your personal information by HWT and Channel Seven Melbourne, and any participating News Limited company, or other connected entities for the marketing purposes as set out next to opt-in boxes and as detailed above.
